Lok Adalat Visit

Every Citizen of India has a Right to an economical and efficacious justice delivery system which in turn upholds the spirit of a democratic system. In order to achieve this goal, the framers of the Constitution prescribed the mandate for social, economic and political justice in its Preamble. The spirit of Article 38 intends to secure to all its citizens, justice-social, economic and political. Article 39A has been embodied in the Constitution of India with an intention to provide free legal aid and to strengthen equal justice to the weaker sections of society.  it is a forum where disputes/cases pending in the court of law or at pre-litigation stage are settled/ compromised amicably.

The college aims at providing Law students, particularly students pursuing their Master’s degree, exposure to the system of alternative means of dispute resolution by organising a visit to the High Court to be part of the Lok Adalat to understand and broaden the interest of the students with regard to alternate dispute resolution( ADR) . The visit enriched the students in understanding the working of the Lok Adalat. All the three branches of LL.M had the opportunity of visiting the High court ON 08. 07. 2017. The three sections of the LLM batch visited three court halls where the Lok Adalat sitting was to take place in The High Court of Karnataka.  The students gained sufficient knowledge with regard to various aspects of Lok Adalat namely:

•    Levels and Composition of the Bench
•    National Lok Adalat
•    State Lok Adalat
•    Mobile Lok Adalat
•    General Procedure followed in the Lok Adalat
•    Nature of cases to be referred to the Lok Adalat
•    Jurisdiction of the Lok Adalat
•    Nature of cases that are referred to the Lok Adalat for settlement
•    Circumstances when consent of the parties is sought.
•    Proceeding of the Lok Adalat
•    Compensation awarded
•    Factors considered while compensation is awarded
•    Pre-Litigation proceedings
•    Appeals
•    Opinion of Judicial member
Apart from these, the students also observed the day’s proceedings closely and also were given an opportunity to go through cases to understand it better. The visit gave the students practical knowledge  of the working of the Lok Adalat in reducing the burden of the Courts.
